1. Acceptance of Terms

By downloading, installing, accessing, or using Trafficmint, you agree to be bound by these Terms of Service. If you do not agree to these Terms, you may not access or use the App.

You represent that you are at least 18 years of age and have the legal capacity to enter into these Terms. If you are using Trafficmint on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

Your continued use of Trafficmint following any updates or modifications to these Terms constitutes your acceptance of such changes.

2. Description of Service

Trafficmint is a mobile application designed to help website owners and SEO professionals monitor and analyze their Google Search Console (GSC) data. The App provides:

• Access to view your Google Search Console performance data
• Analytics visualization and reporting tools
• Search query and page performance tracking
• Historical data comparison and trend analysis
• Customizable dashboards and metrics display

Trafficmint acts as an interface to display data from Google Search Console and does not independently collect or store your website's search data. The accuracy and availability of data depends on Google Search Console's API and services.

3. Account & Access

To use Trafficmint, you must have a valid Google account with access to at least one property in Google Search Console. You will be required to authenticate your Google account and grant Trafficmint permission to access your Google Search Console data.

You are responsible for:

• Maintaining the security and confidentiality of your Google account credentials
• All activities that occur under your account
• Ensuring your use of Trafficmint complies with Google's Terms of Service
• Notifying us immediately of any unauthorized access to your account

We reserve the right to suspend or terminate your access to Trafficmint if we reasonably believe your account has been compromised or is being used in violation of these Terms.

4. Subscriptions & Payments

Trafficmint offers both free and paid subscription tiers:

• Free Tier: Basic access to Trafficmint features with limited functionality
• Pro Monthly: $7.99 per month with full access to all features
• Pro Annual: $59.99 per year (equivalent to $5.00 per month) with full access to all features

Subscriptions are processed and managed through the Apple App Store. By subscribing to a paid tier, you agree to the following:

• Subscriptions automatically renew at the end of each billing period unless canceled at least 24 hours before the renewal date
• Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period
• You can manage and cancel your subscription through your App Store account settings
• Any unused portion of a free trial period will be forfeited when you purchase a subscription

Refunds are handled according to Apple's App Store refund policies. We do not process refunds directly; please contact Apple Support for refund requests.

5. Acceptable Use

You agree to use Trafficmint only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the App in any way that violates applicable laws or regulations
• Attempt to reverse engineer, decompile, disassemble, or derive the source code of the App
• Use any automated systems, bots, scrapers, or similar tools to access or interact with the App
• Circumvent, disable, or interfere with security-related features of the App
• Share, transfer, or sublicense your account or subscription to any third party
• Use the App to access data from Google Search Console properties that you do not own or have authorization to access
• Reproduce, distribute, or create derivative works based on the App
• Use the App for any purpose that could damage, disable, or impair our services or interfere with other users

Violation of these acceptable use provisions may result in immediate termination of your access to Trafficmint without notice or refund.

6. Intellectual Property

Our Intellectual Property: The Trafficmint App, including its design, features, functionality, code, graphics, logos, and all related intellectual property, is owned by us and is protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the App solely for its intended purpose.

Third-Party Trademarks: Google, Google Search Console, and related marks are trademarks of Google LLC. Trafficmint is not affiliated with, endorsed by, or sponsored by Google. All other trademarks, service marks, and trade names referenced in the App are the property of their respective owners.

Your Data: You retain full ownership of your Google Search Console data and any content you create or upload through the App. By using Trafficmint, you grant us a limited license to access and display your data solely for the purpose of providing the services described herein.

7. Disclaimers

TRAFFICMINT IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

• The App will be uninterrupted, error-free, or secure
• The data displayed in the App is accurate, complete, or up-to-date
• The App will meet your specific requirements or expectations
• Any errors or defects in the App will be corrected

The analytics, insights, and data visualizations provided by Trafficmint are for informational purposes only. We are not responsible for any business decisions, actions, or outcomes based on data or information obtained through the App.

You acknowledge that the availability and accuracy of Google Search Console data is dependent on Google's services, and we have no control over or responsibility for Google's data processing, availability, or accuracy.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL TRAFFICMINT, ITS OWNERS, OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of profits, revenue, or business opportunities
• Loss of data or data corruption
• Business interruption or downtime
• Cost of substitute services
• Any other intangible losses

This limitation applies regardless of the legal theory under which such damages are sought, whether in contract, tort (including negligence), strict liability, or otherwise, even if we have been advised of the possibility of such damages.

OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR YOUR USE OF TRAFFICMINT SHALL NOT EXCEED THE TOTAL AMOUNT YOU HAVE PAID TO US FOR THE APP IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

9. Termination

Termination by You: You may stop using Trafficmint at any time. To cancel a paid subscription, you must do so through your Apple App Store account settings. Uninstalling the App does not automatically cancel your subscription.

Termination by Us: We reserve the right to suspend or terminate your access to Trafficmint at any time, with or without cause, and with or without notice, including but not limited to:

• Violation of these Terms of Service
• Violation of applicable laws or regulations
• Conduct that we believe is harmful to other users, us, or third parties
• Extended periods of inactivity
• Technical or security concerns

Upon termination, your right to use the App will immediately cease. Sections of these Terms that by their nature should survive termination shall survive, including but not limited to intellectual property provisions, disclaimers, limitations of liability, and dispute resolution provisions.

10. Changes to Terms

We reserve the right to modify, update, or replace these Terms of Service at any time at our sole discretion. When we make material changes to these Terms, we will:

• Update the "Last updated" date at the top of this page
• Provide notice through the App or via email to registered users
• Give you reasonable time to review the changes before they take effect

Your continued use of Trafficmint after any changes to these Terms constitutes your acceptance of the updated Terms. If you do not agree to the modified Terms, you must stop using the App and cancel any active subscriptions.

We encourage you to periodically review these Terms to stay informed about your rights and obligations when using Trafficmint.

11. Governing Law

These Terms of Service and any disputes arising out of or related to these Terms or your use of Trafficmint shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law principles.

Any legal action or proceeding arising out of or related to these Terms shall be brought exclusively in the federal or state courts located in the United States, and you consent to the personal jurisdiction of such courts.

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
